1. INTRODUCTION AND ACCEPTANCE OF TERMS AND CONDITIONS

These Terms and Conditions constitute a legal agreement between you, either individually or on behalf of an entity (“you”) and Humans Music (“Humans Music”, “we”, “us” or “our”), regarding your access to and use of the humans-music.com site, and any other form of media, media channel, mobile website or mobile application linked, connected or otherwise connected thereto (collectively, the “Site”). You acknowledge that by accessing the Site and/or the Services, you have read, understood and agree to be bound by all of these Terms of Use.

In order to use the Services, you must (1) be 18 years of age or older, and (2) have the authority to enter into a binding agreement with us by your acceptance of these Terms.

2. Modification of terms and conditions

We reserve the right to make changes to these Terms of Use from time to time, in whole or in part, at our sole discretion, at any time and without notice, by posting an updated version of the Terms of Use on the Site or when you access the Services. When we do so, we will revise the “last updated” date at the beginning of the Terms of Use. When we make material changes to these Terms of Use, we will notify you in a manner appropriate to the circumstances, for example by posting a prominent notice on the Site and/or sending you an e-mail. In some cases, we will notify you in advance, and your continued use of the services after changes have been made will constitute your acceptance of those changes. Please be sure to read any such notices carefully. If you do not wish to continue to use the service under the new version of the terms of use, you may terminate your account by contacting us using the contact details provided in these terms of use.

3. Buying on the site

The services or products offered for sale are described and presented as accurately as possible on the Site.
The purchase of a Music Planet Pack™ or membership as a member corresponds to the order for the performance of an environmental protection service or membership as a member for a period of 1 year.

4. Payment by credit card

Customers may use their credit card when purchasing directly on the Humans Music website, where they authorize Humans Music to debit the agreed amount from the payment card. Customers may use Visa, Mastercard, Discover or American Express as a means of payment. Humans Music does not charge transaction fees.

Customers may file a claim for “unauthorized debit” with their card issuer within a maximum of 14 days of purchase, unless other conditions have been agreed with the card issuer.

Humans Music uses the Stripe payment service to handle payments. Stripe is responsible for all aspects of card data collection and processing, and is the company to contact if you have any questions about the use and processing of card data.

5. Execution of operations

The services and operations contained in the Music Planet Packs™ may depend on a minimum quantity to be reached before they can be fully executed depending on our partners. Humans Music undertakes to communicate regularly on the progress of operations in progress.
The operation named “Green Action Festivals” will be considered complete when a minimum of 10,000 Music Planet Packs™ have been sold.
The execution of the service described on the https://humans-music.com/green-action-festivals/ page will then be launched and Humans Music undertakes to communicate regularly on the actions carried out by this operation.

6. Warranty

Humans Music reserves the right to extend the end date of an operation at any time and without prior notice in order to guarantee the achievement of the objectives set.
In the event that the objective cannot be reached, Humans Music may unilaterally decide to execute a part of the service in line with the level of the objective reached.

7. Force Majeure

“Force Majeure” means a circumstance beyond the control of the relevant party, the effects of which could not reasonably be avoided or overcome by said party, including, but not limited to, war, civil war, riot, political unrest, government restrictions, regulatory orders, import or export bans or other government intervention, acts of God, vandalism, theft, failure of power supply, failure of communication lines, seizure of funds, labor disputes, lockouts and strikes, epidemics or pandemics.

Neither party shall be liable for any failure or delay in the performance of its obligations resulting from or caused, directly or indirectly, by any Force Majeure affecting the party for the duration of such Force Majeure event. In the event of Force Majeure lasting more than 30 (thirty) days, either Humans Music or the customer may terminate the part of the contract not yet performed. Upon such termination, each party will be released from its respective remaining obligations without liability, and Humans Music will reimburse the customer the pro rata amount of its order for the portion of the service that could not be performed.

8. Right of withdrawal

In accordance with article L221-18 of the French Consumer Code, customers have 14 calendar days from the date of their order to exercise their right of withdrawal, without having to justify their decision or pay any penalties.

– To exercise this right, the Customer must notify his decision in writing (e-mail or post).

9. Privacy policy

Humans Music requests the following information when customers make a purchase:

Last name, first name, address and e-mail.

Humans Music complies with the requirements of the current legal framework for data processing. Please read our Privacy Policy.

If the customer finds that this information is incorrect, he or she has the right to have it corrected. In certain circumstances, Humans Music is obliged to delete the customer’s personal data if the customer so requests. This may be the case, for example, if the customer’s data is no longer required for the original purpose for which it was requested. The customer may also contact Humans Music if he or she is dissatisfied with any aspect of the processing of his or her personal data, or if he or she believes that such processing does not comply with the law. If the customer wishes to make use of one or more of their rights relating to the RGPD, they can contact us via the site’s contact form.

10. Cookie Policy

The website and mobile applications used by Humans Music may use cookie technology to collect additional data about users’ use of the site. Humans Music uses cookies to better understand how customers use the website services, to track the overall use of the site by its users and to provide services.

Customers may set their browser software not to accept cookies. If the customer chooses not to accept cookies, certain parts of the functionality of the websites and mobile applications provided by Humans Music may be altered.

11. Limitation of liability

The liability of either party excludes incidental, special, indirect or consequential loss or damage resulting from the performance of the service.

To the extent permitted by law, either party’s liability under or in connection with Humans Music’s services shall be limited to Humans Music’s service fees.

12. Validity, applicable law and place of jurisdiction

The validity of these terms and conditions shall not be affected by the invalidity or unenforceability of any part of these terms and conditions. The present general terms and conditions, as well as any order confirmation made with Humans Music, are subject to French law. If a dispute cannot be resolved, the court of the city of Cannes shall have sole jurisdiction.
